The terms and conditions ("information") compiled in this document are subject to change without notice. It is the responsibility of the any person seeking to rely on the information by visiting our website at www.toybiz.com.au or by contacting Toybiz at Facebook. "Toybiz", "we", "us" and "our" are references to Toybiz, the trading name of Toybiz Australia Pvt. Limited A.B.N. 43 154 846 929 - a company registered in Australia under the Corporations Act 2001. A reference to “you” to “your” is a reference to a Toybiz customer.
The Terms and Conditions in this document govern the use of Toybiz's Online Shopping Service (the Service). The Service includes shopping, returns, and participation in promotions run by Toybiz.
A. Processing, Shipping & Delivery
Christmas Holidays Processing Times
Orders placed from the 20th-December through to January 3rd will begin shipping from January 3rd 2018
(I) Processing Times
Our Processing Times range from one day to four days depending on the availability of the products. As a guide, over 80% of our orders are processed the following day after order. We strive to ensure that processing times are as short as possible, however logistics are complicated and sometimes our stock levels might be out due to human or computer error, our suppliers may supply the wrong product or not at all due to factors outside our control. Where this happens, we will contact you within 3 days of placing your order to let you know if the processing time will be longer than 4 days.
(ii) Shipping Policy
So what is Toybiz's Shipping Policy?
Australia is a big, vast country and our population is spread all over in isolated patches. As such, shipping can be costly. Shipping costs for parcels are not standard across weights and distances, they vary according to where you are and how much your parcel weighs. Toybiz has worked hard to find an economical solution for our customers to make sure the benefits of our shipping policies outweigh the costs of you physically searching for the products we have. We've also tried to make it fair and equitable. We've also tried to make it easy. This is what we've come up with.
When do I receive FREE Shipping?
Shipping is FREE for orders over $99.00 for both Standard and Large Parcels for shipping to Metropolitan Areas.
Shipping is FREE for orders over $200.00 for both Standard and Large Parcels for shipping to Regional Areas.
The total value of your after all discounts must exceed the above FREE SHIPPING thresholds for FREE SHIPPING to apply
How much will Shipping cost me if I don't qualify for FREE Shipping?
At Check Out your shipping costs will be calculated based on:
- how much you spend;
- your location; and
- the weight of your parcels.
This section gives you a guide of how the shipping costs are determined.
To assist you in determining whether your order will be a Standard, Large or Oversized Parcel please see below:
- Standard- A parcel weighing up to 5kgs (this is over 95% of our orders)
- Large- A parcel weighing from 5kgs to 15kgs (this is a lot of toys)
- Oversized - A parcel weighing over 15kgs (the really big stuff)
Now you know what the sizes are, the below table is a guide to how much shipping will cost within Australia.

(III) Delivery Guide
We use established courier companies to ensure the fastest possibly delivery to you. Australia is a vast nation and shipping sometimes can be beyond our control. The below table is a guide as to when you can expect to have your goods delivered to you after Toybiz has processed your order.
We will endeavour to contact you should there be any delay in the below delivery times.
Notes on Delivery Guide:
- We do not ship to P.O. Box addresses or Parcel Lockers.
- Orders will require signature on delivery.
- Delivery times are based on working days and are approximate only.
- No liability is accepted for late delivery.
- Delivery times may vary according to weather, road conditions and seasonal overload such as Christmas.
- Orders are shipped with Fastway Couriers and Startrack within Australia.
- You will be provided a Tracking Number to track delivery of your goods.
(IV) What if no one is there to receive the Goods I have ordered?
The best way to ensure this is to have them delivered to a business address or follow the tracking and make sure you or someone else is available
If, as we know sometimes happens, there is no one there; the parcel will be delivered to the nearest courier depot or Post Office for your collection.
B. Exchanges, Returns and Refunds
All of your purchases from Toybiz are covered by the Australian Consumer Law. As such you have certain rights with respect to warranties and guarantees. Toybiz will ensure it abides by the Australian Consumer Law.
(I) Returns for Exchange
If you’re not happy with your purchase because you have not chosen the right product, we are happy to offer a store credit or exchange. This is what we refer to as an Exchange. If you decide to apply for an exchange or store credit, the following conditions apply:
a. Please contact firstname.lastname@example.org to arrange a return for the product. Returns must be received by Toybiz within 21 days of the customer receiving the product(s).
b. The product(s) should be in its original condition and packaging undamaged.
c. Freight cost to RETURN the product to Toybiz is covered by the customer. You are responsible for any lost returned parcels so please send it back to us via a traceable method like registered post or traceable courier.
d. Freight cost to send you the exchanged product(s) is covered by you and will be invoiced to you and you will be required to pay for the shipping prior to the goods being shipped to you.
e. If you cannot find a suitable product to exchange, you may apply for a Store Credit. Please note we do not give refunds for exchanges. Store credits cannot be used for shipping and can only be applied against the purchase of another product.
f. With your return for Exchange please include with the return a copy of your original purchase email containing and a statement containing:
- Order number
- Contact Details
- Exchange or Store Credit Request
(II) Returns for Faulty Products
Under the Australian Consumer Law as a supplier we are responsible to ensure that the products we sell are fit for purpose and free from faults. If you receive a product that was faulty from the manufacturer, please follow these instructions:
a. If a product is faulty, it should be returned to us within 21 days of you receiving the item.
b. Please contact email@example.com to arrange a return for the product. We pay for shipping back to us.
c. Faulty products once received by Toybiz can be exchanged for new one, a different product, store credit or full refund.
d. Where you chose a store credit we will give you an additional 10% of the value of the product as our way of saying sorry for the inconvenience.
e. With your faulty product please include with the return a copy of your original purchase email containing and a statement containing:
- Order number
- Contact Details
- Exchange, Store Credit or full refund
C. Colours and Sizes
Toybiz provides high quality pictures of our products. Please be aware that whilst we have done all we can to ensure that you see real life colour, depending on your viewing screen the colours may appear slightly different to the actual products.
D. Prices on Toybiz
All prices in the shopping areas are in Australian dollars (AUD) and are inclusive of GST. Toybiz takes all steps to ensure that prices are correct at time of publication; however, we reserve the right to alter prices should we inadvertently publish incorrect prices. If this should happen after you have ordered a product on the site and have passed through the check out, we will contact you prior to sending your order and notify you of the correct price. You will then have to choose to either proceed with your order or cancel the order.
E. Marketing & Promotions
By purchasing products or registering as a member you agree that your details including your email address, mailing address and mobile phone number may be used by us to keep you informed about future products, services and events provided by either Toybiz. If you wish to change your contact mechanism (specify direct mail, telephone or email) or opt out of any communications from Toybiz you can do so by amending your details on our website.
Please note that all items for sale on Toybiz are for retail purposes only and we reserve the right to refund any purchases that are intended for resale purposes.
Toybiz will over time provide content and information which children may find interesting and may wish to access. However, no one under the age of 13 years is allowed to provide any personal information. Minors under the age of 18 years are prohibited from making purchases, including subscriptions, on the Service.
This Service provides general information about Toybiz Limited and the products and services they offer. The information contained in the Service has been prepared solely for the purpose of providing information about Toybiz and the services and products they offer. Toybiz reserves the right to change, delete or move any of the material on the Service at any time without notice.
Toybiz and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the Service. This includes viruses alleged to have been obtained from the Service, your use of or reliance on the Service or any of the information or materials available on the Service, regardless of the type of claim or the nature of the cause of action.
The terms and conditions of Pre-orders are covered by this section:
(I) What is a Pre-order?
From time to time Toybiz will offer products to be sold on Pre-order. Pre-order products will be clearly labelled on the Product Page. A pre-order product is a product that we do not currently have in stock, but have been promised stock from our suppliers. The products on Pre-order are generally products in high demand and by Pre-ordering your product you will be placing yourself ahead in the queue of other customers when the product is delivered into our warehouse.
(II) When will my Pre-order be shipped?
Toybiz will clearly mark in the product description when we expect the product to be shipped. We will also send you an email confirming that your product is a pre-order containing these conditions.
(III) What if I have purchased other in stock products with my Pre-order?
If you have purchased other in stock items with your Pre-order products, your whole shipment will be held until your Pre-order item is ready to be shipped. If you want your in-stock items to be shipped prior to your Pre-order item(s), you may email contact Customer service on www.toybiz.com.au together with a copy of your order and request that your in-stock items be shipped. Please note that this may incur additional shipping charges and shipping charges will be subject to Toybiz’s Shipping Policy contained in these Terms and Conditions.
(IV) What if Toybiz’s Suppliers cannot fulfil your Pre-order by the Time indicated in Product Description?
From time to our suppliers receive delays in suppling products to us which in turn provides a delay to you. These delays are out of the control of Toybiz. If we expect delays, we will notify you in advance. If the delay is greater than two weeks, you will be offered a full refund or store credit. If you decide to take the Store Credit, Toybiz will credit you with an additional 5% of the value of the refunded item. You may, of course, choose to hold your pre-order and secure your product when it arrives.
